The legal basis for this is Art. 6 para. 1 lit. f&nbsp;DSGVO.<\/p>\n<h3>Data proces\u00adsing upon the estab\u00adlish\u00adment of a client relationship<\/h3>\n<p>In the event of a mandate being granted, we collect and process the follo\u00adwing data: Title, first name and surname, e-mail address, address, telephone\/mobile phone number, infor\u00adma\u00adtion neces\u00adsary for the asser\u00adtion and defence of the client within the scope of the mandate or for counselling.<\/p>\n<p>We require these data so that we can identify you as our client, provide you with appro\u00adpriate legal advice and repre\u00adsen\u00adta\u00adtion, commu\u00adni\u00adcate with you, for billing purpo\u00adses, and so that we can handle any liabi\u00adlity claims that may exist and the asser\u00adtion of any claims against the client.<\/p>\n<p>The data proces\u00adsing is perfor\u00admed in response to your request and is requi\u00adred in accordance with Art. 6 para. 1 sentence 1 lit. b DSGVO for the afore\u00admen\u00adtio\u00adned purpo\u00adses for the appro\u00adpriate proces\u00adsing of the mandate and for the mutual fulfilm\u00adent and commit\u00adment arising from the mandate agree\u00adment. The collec\u00adtion of the data is also a prere\u00adqui\u00adsite for the accep\u00adtance of the mandate.<\/p>\n<p>The perso\u00adnal data collec\u00adted will be stored until the expiry of the statu\u00adtory reten\u00adtion obliga\u00adtion for lawyers (6 years after the end of the calen\u00addar year in which the mandate was termi\u00adna\u00adted) and then deleted, unless Capst\u00adone is obliged to store the data for a longer period of time pursu\u00adant to Art. 6 para. 1 sentence c DSGVO on the basis of tax and commer\u00adcial law or profes\u00adsio\u00adnal obliga\u00adti\u00adons to retain and document data (from the German Commer\u00adcial Code (HGB), the German Crimi\u00adnal Code (StGB), the German Tax Code (AO) or the German Federal Lawyers\u2018 Act (BRAO)) or the client has consen\u00adted to further storage pursu\u00adant to Art. 6 para. 1 sentence 1 lit a&nbsp;DSGVO.<\/p>\n<p>The above infor\u00adma\u00adtion does not consti\u00adtute an obliga\u00adtion to retain information.<\/p>\n<p>Beyond this, we also process data of persons with whom there is no (direct) client relati\u00adonship, insofar as this is neces\u00adsary for the initia\u00adtion or imple\u00admen\u00adta\u00adtion of client relati\u00adonships. This means that we can process your data if you are a repre\u00adsen\u00adta\u00adtive, a contact person or an employee of a company that is our client. The same applies if you (or a company of which you are a repre\u00adsen\u00adta\u00adtive, employee or contact person) are invol\u00adved in another way in or out of court (e.g. as a business or negotia\u00adting partner, as an inter\u00advening party, as a joint litig\u00adant, or as an employee of a court) and the proces\u00adsing is neces\u00adsary for the imple\u00admen\u00adta\u00adtion of the client relationship.<\/p>\n<p>In this context, the legal basis for the proces\u00adsing of your perso\u00adnal data is Art. 6 para. 1 lit. f DSGVO. Our legiti\u00admate interest is to enforce our clients\u2018 interests and claims effec\u00adtively. This interest also requi\u00adres the direct contact and collec\u00adtion of perso\u00adnal data of opposing parties, poten\u00adtial witnesses, and other third parties relevant to the adminis\u00adtra\u00adtion of the&nbsp;case.<\/p>\n<h3>Data proces\u00adsing when apply\u00ading for a job with&nbsp;us<\/h3>\n<p>During the appli\u00adca\u00adtion process, regard\u00adless of whether the appli\u00adca\u00adtion is made by e-mail or by postal mail, we process your perso\u00adnal data, usually name, address, e-mail, telephone number, marital status, quali\u00adfi\u00adca\u00adti\u00adons, and, if appli\u00adca\u00adble, other perso\u00adnal infor\u00adma\u00adtion from your cover letter and CV, as well as file attach\u00adments (inclu\u00adding CV and referen\u00adces) that you may provide. The proces\u00adsing is conduc\u00adted for the purpose of contac\u00adting you and asses\u00adsing your suita\u00adbi\u00adlity for the job you are apply\u00ading for. The legal basis is Section 26 para. 1, para. 8 sentence 2 BDSG or Section 26 para. 2, para. 8 sentence 2 BDSG. If your appli\u00adca\u00adtion is unsuc\u00adcessful, this data will be deleted six months after the end of the appli\u00adca\u00adtion process, unless you have expressly agreed to longer storage. You are under no obliga\u00adtion to provide us with your perso\u00adnal data. We would, however, like to point out that your appli\u00adca\u00adtion cannot be conside\u00adred if you do not provide us with your perso\u00adnal data. There will be no further conse\u00adquen\u00adces for&nbsp;you.<\/p>\n<h3>Data proces\u00adsing in the use of a video\u00adcon\u00adfe\u00adren\u00adcing service<\/h3>\n<p>We may use a third-party video confe\u00adren\u00adcing service for telephone calls and online meetings with you. If you attend such meetings, infor\u00adma\u00adtion may be trans\u00admit\u00adted to the respec\u00adtive provi\u00adder. Your parti\u00adci\u00adpa\u00adtion in such a meeting is volun\u00adt\u00adary. If neces\u00adsary, we will be happy to provide you with another way of commu\u00adni\u00adca\u00adting with&nbsp;us.<\/p>\n<p>The legal basis for proces\u00adsing your perso\u00adnal data in the context of online meetings is Article 6 para. 1 lit. b DSGVO (if we hold the meeting for the imple\u00admen\u00adta\u00adtion of a contrac\u00adtual relati\u00adonship with you) or Article 6 para. 1 lit. f DSGVO (if we hold the meeting for other business purpo\u00adses); in the latter case, our legiti\u00admate interest is to be able to use functional and widely used tools for video confe\u00adren\u00adcing services in order to commu\u00adni\u00adcate effici\u00adently with clients and exter\u00adnal partners.<\/p>\n<p>We do not record video or phone confe\u00adren\u00adces. Video confe\u00adren\u00adces are secured accor\u00adding to the state of the art and encrypted end-to-end, provi\u00added that the third-party provi\u00adder offers this from a techni\u00adcal point of view in the speci\u00adfic situation.<\/p>\n<p>Insofar as we use the \u201eMicro\u00adsoft Teams\u201c or \u201eZoom\u201c services for the techni\u00adcal imple\u00admen\u00adta\u00adtion, the follo\u00adwing applies: The service provi\u00adder we use is, in the case of \u201eMicro\u00adsoft Teams\u201c, Micro\u00adsoft Corpo\u00adra\u00adtion, One Micro\u00adsoft Way, Redmond, WA 98052-6399, USA, and in the case of \u201eZoom\u201c, Zoom Video Commu\u00adni\u00adca\u00adti\u00adons, Inc., 55 Almaden Boule\u00advard, Suite 600, San Jose, CA 95113 (collec\u00adtively, Third Party Provi\u00adders). The third-party provi\u00adders process perso\u00adnal data of the parti\u00adci\u00adpants on our behalf, in parti\u00adcu\u00adlar the IP address, the content of the conver\u00adsa\u00adtion, e-mail addres\u00adses, names and possi\u00adbly other service-related data, and store these for the duration of the video confe\u00adrence or, if you use the services beyond that, for the duration of the use. The third-party provi\u00adders are appro\u00adpria\u00adtely obliga\u00adted by us as proces\u00adsors to comply with data protec\u00adtion. The third-party provi\u00adders may also process the data outside the European Econo\u00admic Area (see Trans\u00adfer of perso\u00adnal data to third parties and in count\u00adries outside the European Econo\u00admic Area (EEA).<\/p>\n<h3>Protec\u00adtion of the website<\/h3>\n<p>In order to prevent unaut\u00adho\u00adri\u00adsed access to your data by third parties, we follow the latest techni\u00adcal and organi\u00adsa\u00adtio\u00adnal practi\u00adces. For this reason, we also use SSL encryp\u00adtion for our website in all areas to ensure the best possi\u00adble data security. We expressly advise you that data trans\u00admis\u00adsion on the Inter\u00adnet (e.g. commu\u00adni\u00adca\u00adtion by e-mail) may be subject to security gaps. There is no complete protec\u00adtion against access to&nbsp;data.<\/p>\n<h3>Trans\u00adfer of perso\u00adnal data to third parties and to count\u00adries outside the European Econo\u00admic Area (EEA)<\/h3>\n<p>Your perso\u00adnal data will only be trans\u00adfer\u00adred to third parties if this is permit\u00adted by law or if you have given your prior consent. We will only pass on your data to state autho\u00adri\u00adties within the scope of legal obliga\u00adti\u00adons or on the basis of an official order or court ruling.<\/p>\n<p>There is no trans\u00adfer to recipi\u00adents outside the EEA, with the excep\u00adtion of data proces\u00adsing in the use of other cookies (see Clauses 4 and 5) and a video confe\u00adren\u00adcing service (see Clause 12). The above-mentio\u00adned proces\u00adsing opera\u00adti\u00adons result in the trans\u00admis\u00adsion of data to the servers of the third-party provi\u00adders commis\u00adsio\u00adned by us. These servers are located partly in the USA. If the servers are located in Europe, it cannot be comple\u00adtely excluded that data is nevert\u00adhel\u00adess trans\u00adfer\u00adred to the USA because the provi\u00adders are based in the USA. The data trans\u00adfer occurs on the basis of so-called standard contrac\u00adtual clauses of the EU Commission.<\/p>\n<p>We indicate that the USA is not a safe third country within the meaning of EU data protec\u00adtion law. In certain cases, US compa\u00adnies are obliged to hand over perso\u00adnal data to safety autho\u00adri\u00adties without you as a data subject being able to take legal action against this. There\u00adfore, it cannot be excluded that US autho\u00adri\u00adties (e.g. intel\u00adli\u00adgence services) process, evaluate and perma\u00adnently store your data located on US servers for surveil\u00adlance purpo\u00adses. We have no influence over these proces\u00adsing activities.<\/p>\n<h3>Duration of storage<\/h3>\n<p>We delete your perso\u00adnal data as soon as they are no longer requi\u00adred for the afore\u00admen\u00adtio\u00adned proces\u00adsing purposes.<\/p>\n<h3>Your Rights<\/h3>\n<p>As a data subject, you have the right to obtain confir\u00adma\u00adtion as to whether perso\u00adnal data relating to you is being proces\u00adsed by us and, if so, the right to obtain infor\u00adma\u00adtion about that perso\u00adnal data (Art. 15 DSGVO), the right to have your inaccu\u00adrate data correc\u00adted (Art. 16 DSGVO), the right to have your data deleted (Art. 17 DSGVO) and the right to have your data restric\u00adted (blocked) (Art. 18&nbsp;DSGVO).<\/p>\n<p>You may also object to proces\u00adsing on the basis of Article 6 para. 1 lit. e or f DSGVO (Article 21 DSGVO), in which case you must provide a speci\u00adfic reason, except in the case of direct marketing.<\/p>\n<p>If you have provi\u00added your data, you can request the trans\u00adfer of the data (Art. 20 DSGVO). Whether and to what extent these rights exist in indivi\u00addual cases and under what condi\u00adti\u00adons they apply is speci\u00adfied by law in the designa\u00adted standards. If the proces\u00adsing is based on consent within the meaning of Art. 6 para. 1 lit. a DSGVO, you may revoke this consent at any time for the future (Art. 7 para. 3 DSGVO). In addition, you have the right to contact the compe\u00adtent data protec\u00adtion super\u00advi\u00adsory autho\u00adrity (Art. 77&nbsp;DSGVO).<\/p>\n<h3>No automa\u00adted case-by-case decision<\/h3>\n<p>We do not use your perso\u00adnal data for automa\u00adted case-by-case decis\u00adi\u00adons within the meaning of Art. 22 para. 1&nbsp;DSGVO.<\/p>\n<h3>Changes to the data protec\u00adtion declaration<\/h3>\n<p>New legal requi\u00adre\u00adments, business decis\u00adi\u00adons or techni\u00adcal develo\u00adp\u00adments may require changes to our privacy policy. The data protec\u00adtion decla\u00adra\u00adtion will then be updated accor\u00addin\u00adgly.
